Description of Services

Restoration Kings provides emergency and scheduled property restoration services, including water damage mitigation, fire and smoke damage restoration, mold remediation, storm damage response, commercial restoration, and reconstruction. Specific scope of work, pricing, and timelines for any project are set out in a written estimate or contract signed between you and Restoration Kings.

Our services are performed in accordance with IICRC standards and applicable industry practice.

Emergency Response Disclaimer

We advertise 24/7 availability and dispatch crews as quickly as we reasonably can. Response times mentioned on our website, in advertisements, or on the phone are estimates based on typical conditions. Actual response times depend on crew availability, road conditions, weather, and the specifics of your situation. Estimates are not guarantees.

Once you engage our services, our first priority on arrival is stabilizing the property to prevent further damage. Full restoration and reconstruction follow after the initial mitigation phase.

Estimates and Pricing

Verbal estimates given by phone or on-site are preliminary and may change as the scope of damage is fully understood. Final pricing is documented in a written estimate or scope of work that you review and sign before major work begins.

Emergency mitigation work, such as water extraction and containment, may begin under an authorization to proceed while the full scope is being documented. You will receive written documentation of any work performed.

Pricing on insurance-covered work follows industry-standard estimating software used by carriers and adjusters. Pricing on private-pay work is quoted directly and agreed in writing before work begins.

Insurance Coordination

Restoration Kings works with your insurance carrier when you authorize us to. We document damage, submit photos and scope of work, and communicate directly with your adjuster on the technical aspects of the loss.

We are a restoration contractor, not a public adjuster or licensed insurance professional. We do not negotiate coverage decisions, policy interpretations, or claim settlements on your behalf. Coverage decisions are between you and your carrier.

You are responsible for any deductible, any work performed outside your policy coverage, and any depreciation or amount your carrier does not pay. If your carrier denies coverage, in whole or in part, you remain responsible for the cost of services we performed at your authorization.

Payment Terms

Payment is due according to the schedule set out in your signed estimate or contract. Common structures include:

• Insurance-paid work: payment is due when the carrier issues funds, and any deductible is due at the start of work
• Private-pay work: deposit at signing, progress payments during the project, and final payment on completion
• Emergency mitigation: payment due within thirty days of invoice

Past-due balances may accrue interest at the maximum rate permitted by law. You are responsible for reasonable collection costs, including attorney's fees, on any balance sent to collections. We may place a lien on the property for unpaid work in accordance with applicable state law.

Warranties and Limitations

Restoration Kings warrants that services will be performed in a workmanlike manner consistent with IICRC standards and applicable industry practice. This warranty covers workmanship on the services we perform.

The warranty does not cover:

• Damage or defects in pre-existing conditions of the property
• Materials or products supplied by others
• Damage caused by ongoing leaks, structural issues, or maintenance failures we were not hired to repair
• Normal wear and tear
• Damage from causes outside our control, including weather, mold recurrence in untreated areas, and third-party actions
• Cosmetic variations in matched materials such as paint, tile, and flooring

Warranty claims must be reported to us in writing within a reasonable timeframe after the issue is discovered. Manufacturer warranties on materials pass through to you and are governed by the manufacturer's terms.

Except as stated above, we make no warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Restoration Kings is not liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of our website. This includes lost profits, loss of use, loss of business, and loss of data.

Our total liability for any claim related to our services is limited to the amount you paid us for the services giving rise to the claim.

Nothing in this section limits liability that cannot be limited by law, including liability for gross negligence, willful misconduct, or personal injury caused by our direct actions.

Indemnification

You agree to indemnify and hold harmless Restoration Kings, its owners, employees, contractors, and affiliates from any third-party claim, loss, or expense, including reasonable attorney's fees, arising from your breach of these terms, your misuse of our website, your provision of inaccurate information about the property, or your violation of any law or the rights of another party.

Intellectual Property

All content on gorestorationkings.com, including the Restoration Kings name, logo, photographs, text, and design elements, is owned by Restoration Kings or its licensors and is protected by copyright and trademark law.

You may not copy, reproduce, republish, or use our content without written permission, except for personal, non-commercial use of information on the site. Unauthorized use of our name, logo, or content in advertising, listings, or other commercial contexts is prohibited.

Electronic Communications and SMS

By using our website, calling us, or submitting a form, you consent to receive communications from us electronically, including by email and, if you opt in, by text message. Electronic communications from us satisfy any legal requirement that a communication be in writing.

If you opt in to text messages, the SMS Program section of our Privacy Policy applies. You can opt out at any time by replying STOP to any message you receive from us.

Governing Law

Binding Arbitration

If we cannot resolve the dispute directly within thirty days, you and Restoration Kings agree that any dispute, claim, or controversy arising out of or relating to these terms, our services, or your relationship with us will be resolved by binding individual arbitration rather than in court.

Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, available at adr.org. The arbitration will take place in the county where you received our services, unless we agree otherwise. The arbitrator's decision is final and enforceable in any court of competent jurisdiction.

Class Action Waiver

You and Restoration Kings agree that any dispute will be brought only in an individual capacity. Neither party may bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims from multiple parties and may not preside over any class or representative proceeding.

Exceptions

Either party may bring an individual claim in small claims court if it qualifies for that court. Either party may seek injunctive relief in court to protect intellectual property or confidential information. Nothing in this section prevents you from filing a complaint with a government agency.

Right to Opt Out

You have the right to opt out of this arbitration agreement and class action waiver by sending written notice to the address at the bottom of these terms within thirty days of first agreeing to these terms. Your opt-out notice must include your name, address, phone number, and a clear statement that you decline arbitration. Opting out will not affect the rest of these terms.

Changes to Terms

We may update these Terms of Service from time to time. When we do, we will change the "Last Updated" date at the top of this page. Your continued use of our website or services after a change means you accept the updated terms.
